Crucial steps to take as a workers’ compensation claimant

On Behalf of | Aug 12, 2025 | Workers' Compensation |

A workplace injury can change your routine and create sudden stress. From missing work to managing unexpected medical bills, the pressure can be overwhelming. Knowing what to do after the injury helps take care of your rights and increases your chances of a fair compensation.

Workers’ compensation exists to support injured employees, but the process is complicated in many instances. Knowing the correct steps to follow from the beginning can make your claim more effective and prevent delays.

Get medical attention right away

Your health is the top priority. Seek medical treatment as soon as possible after the injury. Some employers may require you to visit a specific clinic, so ask if there are any guidelines. If your condition worsens or you feel unsatisfied with the first diagnosis, request a second opinion.

Be sure to keep all documents related to your treatment, including reports and receipts, as they help support your claim.

Inform your employer in writing

Once you are safe and stable, report the injury to your employer in writing and within the time frame allowed. When you report early, it shows responsibility and ensures your version of events is recorded while still fresh.

If your employer does not provide a claim form, request one or visit your workers’ compensation board for assistance.

Complete the claim form accurately

Filling out the claim form correctly is a key step. Provide all necessary details, including when, where, and how the injury happened and ensure you list the affected parts of your body and describe any care you have already received. Before you submit it, make a copy and keep it.

Keep detailed records

In writing, articulate how the injury affects your daily life, including days missed at work, the pain you have endured, and how your ability to move or concentrate has been affected. Save every receipt, treatment plan, and message from your workplace or insurer.

Seek legal guidance

Workers’ compensation can sometimes involve disagreements or complex issues and your claim may be denied or delayed. If you find yourself in such a situation, seeking legal guidance can help you understand your options and strengthen your position moving forward.
