If you need to file a claim for workers’ compensation, then you want to give yourself the best chance of success the first time around.
We recently talked about one mistake people sometimes make – failing to report their workplace injury quickly enough. But what are some of the other mistakes people make?
1. Failing to get medical attention
You will not be able to make a successful claim if you do not have a medical report to back it up. In many cases, you may need multiple medical reports, perhaps from different specialists. Either way, it all starts with realizing you should go and get checked out, even if you think you are OK. As well as providing vital evidence to support your claim, doctors are trained to spot injuries and effects of an accident that injured people and those around them may not notice, including those that could require a much greater payout.
2. Ignoring the doctor’s orders
Your employer’s insurer will look at the medical reports to assess how much they need to pay you. If the doctor tells you not to do any strenuous activity for the next six months, then make sure you don’t. Insurers are often reluctant to accept that a person will require as much time off work and medical assistance as a doctor suggests, so they often use tools such as social media or in-person surveillance to monitor claimants for signs that there may be an opportunity to diminish the claim.
There’s a lot you need to get right if you hope to claim the full amount of workers’ compensation you are entitled to. Seeking legal guidance throughout the process will be wise.
